Test Your DUI / Drunk Driving Defense!

Does your case have a defense to it? The truth is the police almost always make mistakes that work in your favor. Even if they don't, DUI prosecutions are subject to attack on many different levels. There is no reason to simply lay down and let the police win.

Test your DUI defense by answering these questions:

  1. Did the officer tell you that your license would automatically be suspended if you refused a breath test?

  2. Did the officer fail to tell you that you had the right to a lawyer before taking any roadside tests?

  3. Did a police officer tell you to "keep blowing" during the breath test?

  4. Were you stopped for any of the following reasons: Speeding, Weaving, Failure to Maintain a Single Lane, Obstruction of Traffic?

  5. Were you involved in an accident in which you suffered any injuries?

  6. Did the officer mistake nervousness or exhaustion for intoxication?

  7. Were roadside sobriety tests conducted on a surface that was not flat, dry and well-lit?

  8. Did the officer fail to observe you for 20 minutes immediately prior to the breath test?

  9. Do you suffer from an injury to your hips, knees, back, joints or elsewhere that would affect your balance?

  10. Did the police fail to advise you of your right to an attorney before taking the field sobriety (balance) test?

  11. Were your field sobriety (balance) tests conducted on a surface that was not even, flat, clean, properly lighted, or protected from the wind?

  12. Did the glare from the police car's overhead lights blind you or make you dizzy?

  13. Were you wearing contact lenses while taking roadside tests?

  14. Were you arrested on private property?

  15. If videotaped, did you appear sober, even if you were scared or exhausted?

  16. Did the officer confuse fear or exhaustion with intoxication (drunkenness)?

  17. Did you recently suffer a concussion (blow to the head) that would duplicate intoxication (drunkenness)?

  18. Do you suffer from diabetes, hypoglycemia or any other condition that might have caused you to seem impaired?

  19. Do you know people who would honestly testify they saw you while you were fine shortly before you were stopped?

  20. Did the Law Enforcement Officer wake you from a deep sleep while you were stopped or parked?

  21. If you were in an accident, did you suffer injuries that might have caused the Law Enforcement Officer to mistakenly believe you were drunk?

  22. Did you wear removable dentures during the breath test?
